I present and develop a novel account of the schematism by reading it through the distinction between constitution and regulation. I thus show that Kant’s stipulation of only eight schemata for the twelve pure concepts of the understanding is not haphazard but answers, instead, to two distinct processes of synthesis, mathematical and dynamical, that either constitute objects in intuition or regulate objects of experience. According to John Rawls, the methods and conclusions of science—when these are non-controversial—constitute public reasons. However, several objections have been raised against this view. This paper focuses on two objections. On the one hand, the associational objection states that scientific reasons are the reasons of the scientific community, and thus paradigmatically non-public in the Rawlsian sense. On the other hand, the controversiality objection states that the non-controversiality requirement rules out their public character when scientific postulates are resisted by a significant (...) portion of the citizenry. The paper replies that both objections miss their mark. To the associational objection, it replies that the relevant test for a reason to be public is whether the reasons have been construed under the rules and constrains of a public frame of thought. Insofar as scientific methods and conclusions correspond to the principles of reasoning and rules of evidence that liberals understand as public, their associational origin is secondary. To the controversiality objection, it replies that the standard for a scientific argument to be regarded as non-controversial should refer to its degree of intra-scientific consensus, since ordinary citizens accept or reject scientific pronouncements conditioned to their particular comprehensive views. Nonetheless, a wide extra-scientific agreement on the epistemic virtues of the scientific method will be needed. The paper concludes that there is a good case to think about scientific reasons as public to the extent that scientific reasoning is a mode of inquiry that mirrors a central aspiration of Rawlsian political liberalism: having a public way of thought and an impersonal standpoint to adjudicate between competing claims. A popular account of epistemic justification holds that justification, in essence, aims at truth. An influential objection against this account points out that it is committed to holding that only true beliefs could be justified, which most epistemologists regard as sufficient reason to reject the account. In this paper I defend the view that epistemic justification aims at truth, not by denying that it is committed to epistemic justification being factive, but by showing that, when we focus on the relevant (...) sense of ‘justification’, it isn’t in fact possible for a belief to be at once justified and false. To this end, I consider and reject three popular intuitions speaking in favor of the possibility of justified false beliefs, and show that a factive account of epistemic justification is less detrimental to our normal belief forming practices than often supposed. In a recent paper in this journal, Carter and Peterson raise two distinctly epistemological puzzles that arise for anyone aspiring to defend the precautionary principle. The first puzzle trades on an application of epistemic contextualism to the precautionary principle; the second puzzle concerns the compatibility of the precautionary principle with the de minimis rule. In this note, I argue that neither puzzle should worry defenders of the precautionary principle. The first puzzle can be shown to be an instance of the (...) familiar but conceptually harmless challenge of adjudicating between relevant interests to reach assessments of threats when applying the precautionary principle. The second puzzle can be shown to rely on a subtle but crucial misrepresentation of the relevant probabilities at play when applying the precautionary principle. (shrink)

Does transparency in doxastic deliberation entail a constitutive norm of correctness governing belief, as Shah and Velleman argue? No, because this presupposes an implausibly strong relation between normative judgements and motivation from such judgements, ignores our interest in truth, and cannot explain why we pay different attention to how much justification we have for our beliefs in different contexts. An alternative account of transparency is available: transparency can be explained by the aim one necessarily adopts in deliberating about whether to (...) believe that p. To show this, I reconsider the role of the concept of belief in doxastic deliberation, and I defuse 'the teleologian's dilemma'. (shrink)

Intercultural research poses critical ethical challenges. In 2019, in collaboration with more than 200 researchers from more than 30 countries, a group of researchers developed an ethical conflict analysis model that seems relevant for Latin America. The model proposes a flexible frame of reference where ethical challenges depend on four factors present throughout the research process: the place where the research is carried out, the people involved, the relevant ethical principles, and the precedents from previous research. This article discusses the (...) applicability of this model through two case analyses: one study with Indigenous peoples in Chile and the other with Latin-American migrants on the border between Mexico and US. Neil MacCormick says that his "version of institutional theory" about the law 'is "non positivist", or, if you wish, "post-positivist"'. He is aware, however, that his work could be perfectly labelled, from the point of view of the history of legal and moral thought, as a form of natural law theory, at least by those who adhere to some version of natural law. It is an important merit of MacCormick that, rising above the label walls and wars, his theory of (...) law has taken into account the main insights of the great authors belonging to both traditions, such as Hans Kelsen and Herbert Hart, on the so-called "positivist" side, and some authors in the Thomistic tradition, particularly John Finnis, as well as "the writings of seventeenth and eighteenth century jurists concerning natural jurisprudence and the law of nature", on the so-called "natural law" side. Writing with such openness to all sources and insights, Neil MacCormick, one of the most eminent legal philosophers of our time, does not surprise us when he chooses to end his lifetime's work with an attempt to dig into the ethical foundations of all that he has written on law and politics. Practical Reason in Law and Morality is, in a way, his most significant book. He tackles here the deeper issues that he himself realised were left open and uncertain in his salient works on legal theory. He considered this book as the last one in a quartet on "Law, State, and Practical Reason". The quartet itself has become the culmination of a life devoted to the common good, in academia and in politics, among many other endeavours. Notwithstanding its flaws, I am convinced that Neil MacCormick's last book can be illuminating for all those students, and even professors, who go about doing legal philosophy without ever reading anything antedating Hart's Concept of Law. They tend to be confused by sophisticated forms of scepticism, luxurious discussions on law and morality and metaethics, and all sorts of distrust of truth in practical matters. Hence they will surely benefit from reading how a great legal philosopher of our time, once equally confused but always honestly open to rational deliberation and fair discussion, freed himself of at least half of his misunderstandings, and learned a lot by reading some natural law theorists old and new. In this paper I propose a teleological account of epistemic reasons. In recent years, the main challenge for any such account has been to explicate a sense in which epistemic reasons depend on the value of epistemic properties. I argue that while epistemic reasons do not directly depend on the value of epistemic properties, they depend on a different class of reasons which are value based in a direct sense, namely reasons to form beliefs about certain propositions or subject matters. (...) In short, S has an epistemic reason to believe that p if and only if S is such that if S has reason to form a belief about p, then S ought to believe that p. I then propose a teleological explanation of this relationship. It is also shown how the proposal can avoid various subsidiary objections commonly thought to riddle the teleological account. The theory of belief, according to which believing that p essentially involves having as an aim or purpose to believe that p truly, has recently been criticised on the grounds that the putative aim of belief does not interact with the wider aims of believers in the ways we should expect of genuine aims. I argue that this objection to the aim theory fails. When we consider a wider range of deliberative contexts concerning beliefs, it becomes obvious that the aim (...) of belief can interact with and be weighed against the wider aims of agents in the ways required for it to be a genuine aim. They have chosen mild cognitive impairment (MCI) as the target of their scrutiny and have raised several interesting issues. I would like to comment on their approach and suggest that MCI is a (...) useful clinical entity that does serve a practical function and hopefully will lead to a better quality of life for aging persons.There are several clarifications concerning the construct of MCI that need to be emphasized. Graham and Ritchie have asserted that all persons with MCI eventually evolve to Alzheimer's disease (AD) and have claimed that this is the inevitable outcome of the disorder. Although it is true that many of the early studies on MCI focused on the amnestic subtype as a precursor to AD (Bennett et al. 2002; Ganguli, Dodge, Shen, and DeKosky 2004; Lopez et al. 2003; Petersen et al. 1999), subsequent work has expanded the construct to include prodromal forms of other disorders (Petersen 2004; Winblad et al. 2004). As such, the construct of MCI has become flexible in recent years to account for alternative types of intermediate cognitive impairment.The authors state that MCI addresses those individuals speculated to have an inevitable dementia. Certainly, we do not presume that dementia is inevitable in the aging process; rather, we posit that if certain criteria are fulfilled in persons who are aging, the likelihood of a person progressing to a certain type of dementia is quite high. As such, this is an important precondition about which to learn, because interventional strategies may be available.Graham and Ritchie argue that some cognitive changes with aging are "normal" and trying to classify these individuals as "abnormal" is performing a disservice to much of the aging population. In a recent article in this journal, Esteban Céspedes (2015) seeks to defend the contrastive account of singular causation from my criticisms (Steglich-Petersen 2012). Céspedes objects to my argument on three counts: (1) it is circular in presupposing a principle that it seeks to establish; (2) that same principle is false; and (3) even if the principle were true, it would not speak against the contrastive account. In this note I argue that all three objections are unconvincing.

Many epistemologists have been attracted to the view that knowledge-wh can be reduced to knowledge-that. An important challenge to this, presented by Jonathan Schaffer, is the problem of “convergent knowledge”: reductive accounts imply that any two knowledge-wh ascriptions with identical true answers to the questions embedded in their wh-clauses are materially equivalent, but according to Schaffer, there are counterexamples to this equivalence. Parallel to this, Schaffer has presented a very similar argument against binary accounts of knowledge, and thereby in favour (...) of his alternative contrastive account, relying on similar examples of apparently inequivalent knowledge ascriptions, which binary accounts treat as equivalent. In this article, I develop a unified diagnosis and solution to these problems for the reductive and binary accounts, based on a general theory of knowledge ascriptions that embed presuppositional expressions. All of Schaffer's apparent counterexamples embed presuppositional expressions, and once the effect of these is taken into account, it becomes apparent that the counterexamples depend on an illicit equivocation of contexts. Since epistemologists often rely on knowledge ascriptions that embed presuppositional expressions, the general theory of them presented here will have ramifications beyond defusing Schaffer's argument. En el presente artículo nos ocupamos de dos de ellos: juego y muerte. A modo de destacar algunos de los rasgos primordiales de estos fenómenos -juego y muerte- cabe decir del primero que sobre todo destaca la fantasía, la ficción, y ambos relacionados a su vez con la estructura específicamente lúdica del como-si. De modo espontáneo el niño juega como-si fuera (...) policía, ladrón, rey, plebeyo, padre, madre e incluso niño, es decir, el niño transita con la mayor naturalidad a mundos ficticios. Y esto mismo hará posteriormente el actor profesional. Ello revela a la par el parentesco entre juego y arte. En el caso de la muerte, probablemente lo que más corresponde destacar es su carácter de fenómeno filosófico fundamental, dado que ella se asocia con la concepción del ser en tanto devenir, como que todo lo que es, está transido por el llegar a ser y dejar de ser. How to highlight some of the key features of these phenomena -play and death- it may be said of the first that stands out above all the fantasy, fiction, and both in turn related to the specifically playful structure of the as-if. Spontaneously the child plays as-if he was police, thief, king, plebeian, father, mother and even child, i.e. the child passes naturally to fictional worlds. And the same will do later on the professional actor. This shows at the same time the relationship between play and art. In the case of death, in the first place should be noted its condition as a fundamental philosophical phenomenon, since it is associated with the conception of being as becoming, which implies that everything that is, is determined by the coming to be and the passing away. Resumen: La intención del presente artículo es reexaminar el concepto bergsoniano de Duración entendido como coexistencia de niveles de multiplicidad heterogéneos. Si bien dicho concepto ha sido pensado a partir de una comprensión que podría ser caracterizada como continuista, el mismo Bergson evitará confundir dicha continuidad con la idea de homogeneidad. Intentaremos mostrar que la determinación del concepto de Duración se alcanza al definirla como tensión o entrelazamiento entre sucesión y simultaneidad, y por consiguiente, como una multiplicidad que hace coexistir (...) diferentes flujos de duración. Para ello, Bergson propone la existencia de un Tiempo impersonal y único como base para la relación entre duraciones. Nuestra hipótesis es que esta misma situación puede entenderse mejor si se articula el concepto de ritmo en la obra de Deleuze, concepto ligado íntimamente a las nociones de duración y coexistencia. Although this concept has been thought of from a point of view that could be characterized as "continuist", Bergson himself avoids confusing this continuity with the idea of ​​homogeneity. We will try to show that the determination of the concept of durée is reached by defining it as a tension or interlacement between succession and simultaneity, and therefore as a multiplicity based on the coexistence of different flows of duration. Bergson proposes the existence of an impersonal and unique time as the basis for the relationship between durations. Our proposal is that this same situation can be better understood through the concept of rhythm as articulated in Deleuze's work, a concept closely linked to the notions of Durée and coexistence. Through the movements of contraction, dilation, reunion, and division, rhythm operates along with the available durations as a field of relation, being able to occupy the place that had been assigned to unique time. Deleuze’s philosophy is permeated with the problem of the continuum. The idea that the coexistence of durations is implied in the concept of duration itself allows Deleuze to offer a fresh perspective on multiplicity, which is distinct from Bergson’s approach, and which proposes new perspectives on the continuum. While Deleuze critiques Leibniz’s view on this concept by highlighting the non-uniform nature of the continuum, the infinitesimal still plays a significant role in his analysis. However, in his late reading of Leibniz, (...) Deleuze emphasises that folds, rather than infinitesimals, should be considered as the smallest components of the continuum’s labyrinth. This implies that there is a union of indiscernible cuts in the continuity, cuts that do not create gaps or breaks in the overall coherence, but rather a labyrinth. I will show how, in exploring this problem, Deleuze and Guattari draw inspiration from Kafka, in order to relate continuity to contiguity. This relation reveals an internal difference that defines the distinction between what is continuous and what is contiguous. This, in our view, marks a considerable shift between Deleuze’s early reading of Bergson and his late reading of Leibniz, and it allows Deleuze to further develop his idea of the continuum. (shrink)

I argue that, contrary to intuition, it would be both possible and permissible to design people - whether artificial or organic - who by their nature desire to do tasks we find unpleasant.

The status of scientific knowledge in political liberalism is controversial. Although Rawls argued that the noncontroversial methods and conclusions of science belong to the kind of reasons that citizens can legitimately call forth in public deliberation, critics have observed that the complexity and elaborateness of scientific arguments drive them away from the spirit of public reason, i.e., that which should reflect judgments that are the product of general beliefs and forms of reasoning found in common sense. In other words, scientific (...) claims remain as inaccessible as esoteric or religious reasons. This paper contends that this objection can be met by introducing a crucial assumption, drawn from W. V. O. Quine and the ‘naturalized epistemology’ tradition: that scientific reasoning and everyday reasoning are not two different epistemic categories but rather form a continuum. The former is just a filtered or refined version of the latter. Accordingly, evidence-based scientific reasoning is common to all citizens, regardless of their actual acceptance of specific scientific claims. Following the Quinean Assumption, political liberals may argue that, unlike religious or esoteric sources of knowledge, scientific reasoning is the expression of a cognitive operation that is fundamentally shared across comprehensive doctrines and politically reasonable individuals. Inquiry is an aim-directed activity, and as such governed by instrumental normativity. If you have reason to figure out a question, you have reason to take means to figuring it out. Beliefs are governed by epistemic normativity. On a certain pervasive understanding, this means that you are permitted – maybe required – to believe what you have sufficient evidence for. The norms of inquiry and epistemic norms both govern us as agents in pursuit of knowledge and understanding, and, on the (...) surface, they do so in harmony. Recently, however, Jane Friedman (2020) has pointed out that they are in tension with each other. In this paper, I aim to resolve this tension by showing that reasons for acts of inquiry – zetetic reasons – and epistemic reasons for belief can both be understood as flowing from the same general normative principle: the transmission principle for instrumental reasons. The resulting account is a version of epistemic instrumentalism that offers an attractive unity between zetetic and epistemic normativity. (shrink)

There have been persistent philosophical efforts to demarcate the province of science. Fewer attempts have been made to explore whether these demarcation strategies are consistent with the liberal promise of religious neutrality. Within this framework, most liberal political theorists seem to agree that hypotheses suggesting supernatural agency should remain outside the purview of science by principle. In their view, this rule of methodological naturalism is neutral in the relevant sense, since it is silent towards ultimate questions. This paper examines whether (...) this is so, especially when discussing the content of the science curriculum in public education. In this context, advocates of the status of Intelligent Design creationism as a scientific theory argue that MN arbitrarily dismisses a type of supernatural agency that is fundamental to several branches of theistic belief. Drawing on Thomas Nagel’s position, the paper contends that MN assumes a meta-scientific position to which either god does not exist, or god does not intervene in cosmic history. To that extend, MN cannot be reconciled with LPRN. However, this conclusion does not entail that hypotheses that suggest supernatural agency must be included in the science curriculum. Creationist theories may remain excluded to the extent that they fall short of the standards that are required for a proficient scientific account. But, crucially, it will not be their religious character what keeps them out of the classroom, but a series of pseudoscientific wrongs which are non-exclusive to supernaturalistic hypotheses. The paper thus suggests the exploration of an alternative demarcation strategy, one that is consistent with LPRN. (shrink)

Several liberal philosophers and penal theorists have argued that the state has a reason to prohibit acts that harm individuals. But what is harm? According to one specification of harm, a person P is harmed by an act (or an event) a iff, as a result of a, P is made worse off in terms of well-being. One central question here involves the baseline against which we assess whether someone is ‘worse off’. In other words, when a person is harmed (...) he is worse off, certainly—but what is worse off a variation from? A central part of the paper critically discusses different answers to this question based on versions of what we can call: the temporal baseline, the baseline from mankind and the counterfactual baseline. Essentially, it will be argued that the counterfactual baseline leaves us with a better understanding of harming than the other baselines discussed. The final part of the paper will describe some of the implications of our investigation for the application and evaluation of the view that harm matters in the justification of which type of acts should be criminalized by the state. The overall conclusion of the paper is that adherents of a view like the harm principle face a dilemma. Either they can accept the counterfactual baseline but then, they can do without the harm principle. Or they can reject the counterfactual baseline—but then they will have to formulate an alternative baseline which, as will be shown in the paper, is no easy task. (shrink)

Many philosophers have argued that an event is lucky for an agent only if it was suitably improbable, but there is considerable disagreement about how to understand this improbability condition. This paper argues for a hitherto overlooked construal of the improbability condition in terms of the lucky agent’s epistemic situation. According to the proposed account, an event is lucky for an agent only if the agent was not in a position to know that the event would occur. It is argued that although not detrimental to the anti- luck program, the epistemic account of luck sets certain important limits to its scope and feasibility. (shrink)

In a recent paper (2008), I presented two arguments against the thesis that intentional states are essentially normative. In this paper, I defend those arguments from two recent responses, one from Nick Zangwill in his (2010), and one from Daniel Laurier in the present volume, and offer improvements of my arguments in light of Laurier’s criticism.

Standard epistemology takes it for granted that there is a special kind of value: epistemic value. This claim does not seem to sit well with act utilitarianism, however, since it holds that only welfare is of real value. I first develop a particularly utilitarian sense of “epistemic value”, according to which it is closely analogous to the nature of financial value. I then demonstrate the promise this approach has for two current puzzles in the intersection of epistemology and value theory: (...) first, the problem of why knowledge is better than mere true belief, and second, the relation between epistemic justification and responsibility. Body checking, characterized by the repeated visual or physical inspection of particular parts of one’s own body (e.g. thighs, waist, or upper arms) is one of the most prominent behaviors associated with eating disorders, particularly Anorexia Nervosa (AN). In this paper, we explore the explanatory potential of the Recalcitrant Fear Model of AN (RFM) in relation to body checking. We argue that RFM, when combined with certain plausible auxiliary hypotheses about the cognitive and epistemic roles of emotions, is able to (...) explain key characteristics of body checking, including how body checking behavior becomes habitual and compulsive. Cet article passe en revue les principaux points à retenir des travaux de Gilles Fauconnier, en particulier de son travail collaboratif avec Mark Turner sur la théorie du _blending_, pour les lecteurs qui ne sont pas familiers avec ce cadre théorique ou qui pourraient bénéficier d'un regard extérieur. Je souligne les leçons globales à tirer des notions d'espaces mentaux et de leurs connexions ou _mappings_, les avantages d'utiliser de petits packages au lieu de grands domaines pour analyser l’activité conceptuelle, comment (...) les réseaux d'intégration (_blending networks_) nous permettent d'aller au-delà de simples projections ou correspondances entre domaines de l'expérience, ainsi que la nécessité d'étudier des modèles qui fournissent un pont entre les principes généraux et les exemples riches et contextualisés qui les exposent. El presente ensayo se fija como propósito precisar la crítica hegeliana del Derecho natural y del Derecho abstracto y determinar una doctrina propiamente hegeliana del Derecho. En este sentido, nuestra hipótesis es que es en el contexto de la doctrina de la Sittlichkeit,que el Derecho debe ser comprendido según Hegel. En efecto, en sus Lecciones sobre la filosofía de la historia, Hegel define la Sittlichkeit como un “orden de lo sustancial de suerte que todo sujeto singular tiene la universalidad por (...) propósito, por espíritu y por costumbre ética, y que es en y por este espíritu que él quiere, actúa, vive y goza, si bien que es su naturaleza, a saber su naturaleza segunda y espiritual”2. Luego para Hegel la normatividad jurídica debe ser comprendida al interior de este campo, en un sentido social más amplio de normatividad constituido por la praxis de una comunidad que configura un campo inmanente de objetividad que estructura cotidianamente la vida de los individuos. Lejos entonces de una separación de deber y ser, Hegel nos llama a comprender la forma cómo la norma está presente en el corazón del mundo de la vida como reconciliación de lo racional con lo real en la efectividad. The alien invasive Red King Crab in the Barents Sea represents both a threat, via ecosystem impacts, and a gain as a revenue source from food sales. Uncertainties exist regarding the ecological impacts but debate in Norway has also emphasised the economic benefits to marginalised fisher communities. This paper reports on a Q-methodology study involving key stakeholders to probe the extent to which divisions exist between different groups. While divisions are indeed found and two groupings identified, these are not as (...) clear as suggested by the lines typically portrayed in the media and elsewhere -, i.e. economic gains versus ecological preservation. Stakeholder groups reported here generally agreed that biodiversity concerns should be central and that further invasion was undesirable due to potential impacts on ecosystem services. (shrink)
